This paper examines the criminal liability of a guide for harm arising from ayahuasca ingestion during ritual ceremonies, a practice that has grown notably in recent years. Analyzing the victim's own contribution to their harm, it reviews major doctrinal and jurisprudential positions, especially those from the theory of objective imputation. The study concludes by proposing a dogmatically grounded solution that limits the guide's responsibility based on the principle of victim self-responsibility and case circumstances.
