El estatuto legal internacional de la ayahuasca: una aproximación jurídica y antropológica

The use of ayahuasca in shamanic, religious, psychotherapeutic, and self-knowledge rituals has expanded globally, posing challenges to state legal regimes and international law. International drug conventions and resolutions by the International Narcotics Control Board (INCB) are reflected in various national regulations and judicial rulings. State action to protect public health sometimes creates legal uncertainty, gaps, and rights limitations, while the legal limbo surrounding ayahuasca in many countries produces health risks and confusion in interpreting and applying norms. This work analyzes the different uses of ayahuasca, its search for legitimation, and its legal and factual situation in various states, ultimately reflecting on global legal regulation and the need for a new international legal framework.
